Any facility that has bulk oil or fuel stored in aboveground storage tanks needs a spill plan. Facilities must be non-transportation related, have an aggregate aboveground storage capacity greater than 1,320 gallons or a completely buried storage capacity greater than 42,000 gallons, the facility has a reasonable expectation of a discharge into or upon navigable waters of the United States or adjoining shorelines, and located where a State or Local Regulatory Agency requires a Spill Prevention Plan in accordance with 40 CFR 112.
