Contaminated Product Investigation for Insurers, Europe

Project Description:A global soft drink company and its bottler experienced off-taste and off-odor with their product produced in Belgium and France. This situation arose within a politicized environment within Belgium and other European countries following public outrage over dioxin contaminated animal feed that threatened the human food supply. Though unrelated, the soft drink company's problems resulted in a ban on consumption, a total recall of their products, and a requirement to destroy the impacted products following nationwide consumer complaints. Insurance claims were made for business interruption and property loss. The consortium of insurers, who provided coverage, hired Enviro-Sciences (of Delaware), Inc. (ESI) as the lead technical expert to evaluate causation issues related to these claims. ESI assembled a small multi-technical team and reviewed the claimants' data, reviewed the available public literature, met with members of the Belgium High Hygiene Council and the Food Inspectorate to obtain a critical and complete evaluation of the issues associated with causation. The evaluation helped guide the insurers' determination on how to treat the claims.
