Regulatory Negotiations Reduces the Remedial Costs at a Lubricants Plant

Project Description:Soils associated with a lubricants manufacturing plant's tank farm contained extensive mineral spirits and other petroleum hydrocarbons above state soil standards.
ESI was awarded a fixed-fee remediation contract to bring this site to regulatory closure.
ESI implemented a more focused, yet comprehensive, sampling and reviewed prior assessment work, which covered five years in developing the closure strategy. ESI's evaluation of the additional data and focusing on actual contamination pathways to groundwater revealed that it was unlikely that any of the soil contamination would actually impact groundwater. As a result, no remediation was justified.
ESI prepared a thorough, clear, and well-organized report of our data and findings for presentation to the Kansas Department of Health and Environment (KDHE). It was argued, based upon the data, that no site remediation was warranted. KDHE agreed with our findings and issued a No Further Action letter.
ESI was able to obtain regulatory closure without the proposed remediation approach, and as a result, ESI rebated to the client $1.7 million.
